Terms of Service & Legal Policies

1. Acceptance of Terms

By utilizing this platform, you represent and warrant that you have the legal capacity to enter into this Agreement. We reserve the right, at our sole discretion, to modify, suspend, or discontinue any part of the platform at any time without prior notice. Your continued use of the platform following any changes constitutes acceptance of the revised Agreement.

2. Platform Overview & Scope of Services

Gabriel Music House operates as a Christian-based digital platform facilitating the following core services:

• A directory for discovering and connecting with independent gospel artists.
• An e-commerce storefront for musical instruments and related merchandise.
• The GMH Media Centre, providing aggregated access to third-party gospel content.

3. Booking Services & Agency Disclaimer

3.1 Independent Contractor Status

Gabriel Music House acts solely as an introductory venue. All artists listed on the platform are independent contractors. We do not employ, manage, or act as a legal representative, agent, or manager for any artist.

3.2 Nature of Bookings

Submitting a booking inquiry through our platform does not constitute a binding contract between you and the artist. All negotiations, scheduling, and final agreements are executed directly between the Client and the Artist (or their authorized management).

3.3 Financial Transactions

GMH does not process, escrow, or handle payments for artist bookings. All financial arrangements are made independently by the transacting parties. Consequently, GMH assumes no liability for payment disputes, refund requests, cancellations, or pricing disagreements.

3.4 Limitation of Booking Liability

We are not liable for any direct, indirect, or consequential damages arising from:

• An artist's failure to perform, cancellations, or delays.
• The quality, content, or execution of any performance.
• Miscommunications or breaches of contract between the Client and the Artist.

4. Artist Directory & Intellectual Property

4.1 No Official Affiliation or Endorsement

The inclusion of an artist in our directory is for informational and discovery purposes only. It does not imply that the artist is officially registered with, managed by, or endorses Gabriel Music House.

4.2 Data Sourcing and Accuracy

Artist profiles may be compiled using publicly available information, social media, or voluntary submissions. While we strive for accuracy, we provide all directory information on an "as is" basis and do not warrant that profiles are exhaustive, current, or error-free.

4.3 Takedown and Profile Management

Artists or their authorized representatives retain the right to claim, update, or request the removal of their profile. Such requests must be submitted in writing to our administrative team and will be processed in a commercially reasonable timeframe.

5. E-Commerce & Music Shop Policy

5.1 Merchant of Record

Unlike our booking directory, Gabriel Music House acts as the direct merchant of record for all purchases made through the Music Shop. We assume responsibility for order fulfillment, product condition upon dispatch, and direct customer support.

5.2 Product Representations

We endeavor to display the colors, specifications, and images of our products accurately. However, we cannot guarantee that your device's display accurately reflects the actual product. Minor discrepancies in manufacturing or finish do not constitute a defect.

5.3 Shipping and Delivery

Delivery estimates are provided in good faith but are not guaranteed. Risk of loss and title for items pass to you upon delivery to the carrier. Gabriel Music House is not liable for delays caused by customs, carriers, or force majeure events.

5.4 Assumption of Risk

By purchasing musical instruments or equipment, you agree that Gabriel Music House is not liable for any personal injury, property damage, or hearing loss resulting from the improper use, modification, or prolonged exposure to the purchased items.

6. GMH Media Centre & Third-Party Content

6.1 Content Aggregation and Embedding

The GMH Media Centre curates and embeds gospel content (e.g., sermons, music, documentaries) hosted on third-party platforms such as YouTube and Vimeo. We do not host, store, or transmit the underlying media files on our servers.

6.2 Copyright and Fair Use

All intellectual property rights for embedded content remain exclusively with the original creators and copyright holders. GMH does not claim ownership, nor do we monetize these embedded streams. We operate strictly as a discovery index to drive traffic to original creators.

6.3 DMCA and Takedown Compliance

We respect the intellectual property rights of others. If you are a copyright owner or authorized agent and believe your content has been embedded in a manner that constitutes copyright infringement, please submit a formal takedown notice to info@gabrielmusichouse.com. Valid requests will result in the removal of the embed within 48 hours.

7. Acceptable Use Policy (AUP)

As a condition of your use of the platform, you agree not to:

1. Provide false, misleading, or inaccurate information during registration or booking inquiries.
2. Use the platform for any unlawful purpose or in violation of any local, state, national, or international laws.
3. Transmit any malware, viruses, or malicious code, or attempt to probe, scan, or test the vulnerability of our systems.
4. Scrape, data-mine, or use automated systems (bots, spiders) to extract content from the GMH Media Centre or Artist Directory.
5. Harass, defame, or abuse artists, staff, or other users of the platform.

We reserve the right to terminate your access to the platform immediately, without notice, for any violation of this AUP.

8. Privacy & Data Protection

We are committed to protecting your personal information. We collect only the data strictly necessary to facilitate our services, including but not limited to:

• Identity Data: Name, email address, and phone number.
• Transaction Data: Billing and shipping details for Music Shop purchases.
• Technical Data: IP addresses and browser cookies for site functionality.

We do not sell, rent, or trade your personal data to third parties. Data is utilized solely for order fulfillment, communication, and service improvement. For comprehensive details regarding your data rights, please refer to our standalone Privacy Policy.

9. Disclaimers & Limitation of Liability

THE PLATFORM AND ALL ASSOCIATED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GABRIEL MUSIC HOUSE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL GMH, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR GOODWILL, ARISING OUT OF YOUR USE OR INABILITY TO USE THE PLATFORM.

10. General Provisions

10.1 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Gabriel Music House is domiciled, without regard to its conflict of law principles.

10.2 Severability

If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect.

10.3 Entire Agreement

This document constitutes the entire agreement between you and Gabriel Music House regarding your use of the platform and supersedes all prior agreements, representations, and understandings.
